...and still no ground water sampling of the 2008 seep site, despite a large area of vegetation die-off (suggestive of methane seep) and persistent iron-reducing bacteria near beaver house (also where paralyzed frog was found).

Probable Reason - the COGCC doesn't want to know what's in it... and long reigns the mantle of carefully structured ignorance.

 

 

 

   
 
First photo opportunity to show elk back in the neighborhood. This looks like the same satellite herd of cows I saw in Summerhawk last week.  There are two discernable calves in this herd - probably from this Spring. One calf is visible second from left in front, and the other is kind of in the middle with it's tukas pointed toward us. The black stuff on the back of the cow to the far right front looks like a mass of insects, but it is actually scuffed up hair indicating she has recently bred. EnCana is off the Schwartz site, but a rig is still up on the Juniper Group (Price). The Brown well is still going strong - as you can see by the truck traffic photos below. [10-30-08] Who knows how this year's activities will impact the herd. This photo was taken on the backside of Schwartz.
 

 

     

Still cobbling together my own investigation into the 2008 Divide Creek Seep....

On 10-28-08, I asked the COGCC to inform me of the specific purpose of ["Sundry Notice" dated 01-15-08  /  Document Number:  01986149 / purpose: Notice to Remediate]. This notice was submitted to the COGCC by EnCana.

On 10-30-08, I received the following response from the COGCC.

"The Form 4 was submitted to the COGCC engineering department for approval of a proposed remedial cementing job."

I also requested copies of the two complaints relative to the 2008 seep event. I have done so numerous times in the past and never received them. I received them this time, and I thank the COGCC representative for their timely and helpful assistance in providing all of this information.


In a subsequent phone call the same day, I asked the engineering department several questions (since I have to conduct this investigation myself):

Does a company have to file some form demonstrating completion of the intent?

Yes, they should.

Did they?

No, couldn't locate it if they did. This was unusual (but again, the COGCC is clueless as to what EnCana is up to out here in this area.

Perhaps could tell by the cement bond log.

Nope. It seemed to have been scanned in wrong. Can't read it.

So, no clue whether remedial cement job was completed. And no apparent concern for the situation.

I asked the engineer a couple more questions which he was gracious enough to answer, and for which I am grateful. I am frustrated by this department's apparent lack of vital knowledge of operations in the face of historical and currently evident problems - but nonetheless grateful for the cooperation I did receive.

Under what condition does a company have to advise you of their activities?

I learned that things like taking a kick would qualify.

What purpose may drive such a request? It was purely a guess, but commonly, it is things like gas or water seeping into the casing.

Okay. Well, given that this well experienced a gas kick just prior to this need for remediation.... do you think maybe the two are connected?

Didn't know.

Dead end.

I then asked for the engineer to advise me of the following in a follow-up e-mail. My words follow:

"Thanks so much for walking through the “Sundry Notice” info with me today. I really appreciate the time as well as the guidance.

Thanks for offering to find out if the remedial work was ever completed on the Schwartz 11-2A, relative to that notice [doc #:  01986149].

If possible, I’d like to know the following:

1)     What the work was

2)     Why it was needed

3)     When it was completed (if it was completed)

4)     And whether it successfully corrected the problem

Please also let me know if a corrected scan of the bond log becomes available.

A tight squeeze on our private lane as EnCana brings trucks in and out of the Brown site.

This road is sloppy wet with toxic mag-chloride - presumably a third application (two of which have been within the last couple of days). Despite our concerns over EnCana's favoring of this substance - expressed at the landowner meeting and again in writing - EnCana applied it at one landowner's urging and without offering alternatives such as watering, or the use of other (pine tar- type) substances. EnCana's liberal use of this product on private lanes throughout gas producing regions threatens human health, wildlife, habitat and water sources in proximity to drainages around its application.  But they don't appear to care too much about that.

EnCana extended this section of the road's width before they brought industrial traffic on it. Of course, no common sense approach from EnCana is never without long and monumental effort by someone. Since this road was built for limited rural residential use and was only slightly wider than the truck up ahead of me in this photo, at the time that EnCana demanded access to it, all nine families with deeded ownership pressed for industrial-level upgrades. EnCana of course refused, then finally agreed, then failed to follow-through, then finally bought a property themselves and eventually did the width extension anyway. Why did EnCana force the struggle? Why did they force everyone to go the long way around? This is signature stuff with this company. It's the Bully way.

Our family was the  first to suggest permitted use provided upgrades were made, but, as I said, EnCana threw a major fit and decided to force access (this was before they bought the Dietrich property with polluted water from the Arbaney well explosion).  We decided to stage a sit-in. They finally relented, but not before buying a deputy for the county (see letter to the editor below). Then, after all of that, they negotiated a different access. What a stupid mess.

As tight as it is to pass a truck on this road, can you imagine what it would be like without the extended width? But, that's what EnCana wanted to do. When I argued that an ambulance couldn't get past one of their mammoth trucks if one broke down, the EnCana's project manager actually said: 1) an ambulance could drive around - going through a field, ditch, over a mountain... whatever; or, 2) EnCana could push their trucks off the road. Good grief... this company.

You know, on public, BLM (Bureau of Land Management] land, these kinds of upgrades are standard with any lease. But on private property - we're on our own. Does the county get involved? The state? Not a chance. And how much money does EnCana have? Billions. How much influence can that buy? Lots.

An industry truck rounds a blind curve on the county road. When flagging (warning of wide loads) vehicles are present, they are usually BEHIND these big trucks - but on this day... and the first time I've seen in years... a flag pickup truck was actually in advance of this truck. Not the norm, but glad they were in front today.  [10-28-08]
 

 


 

 
EnCana is running a pipeline along (here) and under county road 331. The site is actually just beyond the photo on the left. It's chaos. Organized chaos I hope. This pipeline is destined for an area adjacent to our private lane....

A couple of years ago EnCana wanted to lay a pipeline in our right-of-way. Geeze Louise. That was a whole other legal issue, I'll talk about when it gets to our road.

Like I said. Bullies.
 

 

 

  All this unrelated truck activity was within a few days and within a mile or so of our place. Maybe it has something to do with a new sign on the County Road that says "Truck Route". It's sad. Just one more reminder of how this once quiet, agricultural area has been handed over to the pillage of industry.

Letters to the Editor of the Post Independent

The Post Independent endorsed both Mike Samson (R-Rifle) and (most shockingly) John Martin (R - 3X incumbent - Glenwood) for Garfield County commissioner, so may not run these letters which I and a family member sent. But, here they are regardless....


"Garfield County’s recent move to solicit big-industry’s funding of a deputy is an alarming continuation of seriously flawed and risky public policy from our failed leadership. 

In 2003 – around the same time we contested EnCana’s illegally forced access and threatened a sit-in - EnCana also funded a deputy. The investment must have paid off, because in 2006, one of EnCana’s subcontractors – bearing signs of intoxication - drove a semi onto our property, uprooted a number of large trees and damaged a vehicle while exiting the property. When the deputy arrived, he essentially coddled the driver and treated my family like they were criminals – angrily sequestering them to a distant section of the yard and stressing that the driver was merely frightened. To our knowledge no sobriety test was conducted.  When we later phoned the department to learn whether trespassing charges had been filed, the driver’s privacy prevented us from gaining information. We never learned what happened and ended up settling the matter with EnCana privately. Fortunately we filmed the incident.

Encouraging private enterprise to finance public safety demonstrates extraordinarily poor judgment.

But, Martin and McCown don’t want to impose upon industry by enacting a fair  impact fee, like Rio Blanco. Private meetings with industry, closed door sessions, private property right give-always…. these actions only enhance the public’s well-suspicioned perception of corruption.

Since another seep erupted on our property in June, the county (excluding recused Tresi Houpt) has refused to conduct ground water sampling or even ask the COGCC for it. The oil and gas liaison has not even visited the site. 

Folks, this county is in serious jeopardy – from our water and wildlife to our air and roadways.  We need genuine leadership. Not an incumbent wielding slick, special-interest-funded literature and fearful of falling from industry’s politically motivated favor. Not John Martin who would pass all the risk and burden onto citizens.

Tresi Houpt needs help defending our county. I support Carter’s desire for transparent governance, and Bershenyi’s commitment to strong, balanced negotiations with an industry whose big-money influence continues to infiltrate even our law enforcement services."


This one is from a family member

"John Martin has to go.

He has consistently demonstrated unabashed loyalty to industry with absolutely no concern for Garfield County citizens, or the environment, wildlife, air or water we all need to survive.  He and McCown’s latest industry favor steals private property, giving it to industry for free worker housing. Whatever industry wants, industry gets from Martin at any cost to citizens. Consider the risks and liabilities landowners have inherited, while Martin gives industry the go-ahead to pillage.

1.         Industry can claim as much land as they want. More wells mean more land and more housing.

2.         “Temporary” can extend into over a year on a pad with multiple wells. Another pad? Another year.

3.         Landowners cannot set foot on their land claimed by industry for the 40 – 80 years industry occupies it.

4.         The landowner continues payments, mortgage, insurance and taxes.

5.         Martin has forced all responsibility and liability for workers onto the landowner including court costs if there’s a problem or the owner contests his “imperial proclamation”.

6.         No surface use agreement is required. Industry posts a small bond and moves in.

7.         These workers are a rough bunch, many of whom are into drinking, drugs, have felonies or other records. They live on the private property 24/7 with full access to the landowner’s home, possessions and intimate knowledge of the landowner’s daily routine. Workers can do whatever they want without fear of being caught when the landowner is not around. Yet the landowner is burdened with proof of theft or destruction.

8.         Martin has put the safety of landowners’ families at serious risk. The county assumes no responsibility, nor even knows who is occupying which property or when. What about single moms, the elderly or older kids staying home alone. Would you let your kids play outside in their own yard with these workers around? I know I wouldn’t.

This is what John Martin calls “respect” for the citizens and “balanced” leadership.  Thank God he is up for “the boot”.  Please vote for Steven Bershenyi to replace him and Steve Carter to replace McCown."            

 

   

 

 

   
Lies, Damned Lies.... and the long-hidden TRUTH about Garfield County Politics.

This week I received a piece of campaign literature that showed incumbent  Republican Commissioner John Martin decked out in his signature 1800's mule skinner look:  long hair, cowboy hat,  puffy white shirt and vest. It was "paid for" by some Grand Junction outfit - some "Western Heritage" organization.

Garfield County has become the focus of outside political power players  because our 'leadership' (ahem...coughbullshit) has zealously allowed gas companies to pillage our county's lands and people for the benefit of big-money gas extraction. 

So, this "lit..er..a..ture" was all about Martin's protection of the environment and people. I about sprained my larynx laughing so hard. What a joke and a bigger bunch of bull feathers. Guess what Martin? It ain't 1871 - even though that's the era of the antiquated Mining Act that allows you to sit back and sell out the county.

No folks. What Martin and his minion sidekick McCown (who - you watch - will now go straight to work for big industry), have done since big oil and gas rolled into the valley is give this county away and sold out the people. Sold everyone and everything down the now-polluted river.

While McCown will probably find a comfy high-paying job in industry after his 'public service' position, I doubt Martin will fare so well for his industry loyalties. Maybe that's why he's vying so hard for re-election. It's so much easier to bully Tresi Houpt and issue proclamations from the throne.

Speaking of Houpt, I'm glad she recently brought to public light what I and some others have known for a long long time. Our county government is all just a big political rat's nest - and God knows, I've been in the thick of it myself since industry came to town. The inner workings of the county's politics are rotted, imperial and ineffective.

Tresi Houpt is the ONLY reason... I'll stress again... the ONLY reason we've had testing conducted at all on this mountain since the new seep was discovered in June. Neither the county nor even the COGCC has expressed any sincere or appropriate interest in assessing or protecting the waters of Divide Creek or its surrounding environment.

GLENWOOD SPRINGS — Garfield County Commissioner Trési Houpt said her unusual step of publicly endorsing candidates for commissioner was prompted in part by her fellow commissioners’ “hostile” relationship with her.

Houpt, a Democrat, said she has been shut out by Republican commissioners John Martin and Larry McCown to a degree that transcends political differences. In a letter to area newspapers, Houpt endorsed Democrat Stephen Bershenyi over Martin, and Democrat Steve Carter over Republican Mike Samson for the seat McCown is vacating.

“I didn’t think it can get any worse,” Houpt said. “I’ve had people daily since I’ve been elected thanking me for what I’m doing and apologizing for the way I’m treated. It kind of rolls off my back now. I came forward because I think this county deserves to have a commission that works for the people of the county and works for a better future for our kids.”

One staff member, who spoke on condition of anonymity because of fears about job security, said many Garfield County staffers worry that being seen with Houpt could jeopardize their positions.

This article blows the lid off the crap that's been simmering for years. The first time I sat in on a commissioner meeting at the courthouse back when Tresi had first been elected, I was embarrassed and appalled at how both John Martin and Larry McCown treated her. They were curt, condescending, and completely disrespectful. She was then and has long been treated as the GarCo whipping girl, when it's Tresi and Tresi ALONE who has consistently brought a common sense approach to county governance and has defended the interests of the people of Garfield County. Had that episode I first witnessed occurred fifty years previous, a gentleman present would have ushered these two clowns out behind a barn for a lesson in manners. Seriously, it's that bad. Watch a video of proceedings sometime. Of course, fifty years ago a woman probably wouldn't have even been elected to the board. Too bad Martin and McCown are still relics of a misguided past.

EnCana's 'pro-environmental' 'pro-community' practices win more friends as someone blows up their Canadian pipeline - for the third time...

Now, sometimes giant corporations become targets of crazy stuff (hot-coffee lawsuits and the like) because they are just that - giant... and some nut wants to leverage their nutness by going after a biggie. I don't know what fuels this type of thing - attention I guess.

But other times, people get pushed so far against a wall that they have nothing left to loose, and take perceived injustices into their own hands. The kinds of things that fuel that kind of behavior have everything to do with notions of protecting one's home, health and family. When these kinds of values and belongings become seriously threatened, people - normal people - get desperate.

I don't know what the circumstances are nor the attendant motives that surround the bombings of EnCana's pipeline in the Tomslake area, but EnCana's pursuit of sour gas (hydrogen sulfide containing natural gas) in the area probably has something to do with it. Hydrogen Sulfide [H2S] - even trace amounts in the air - can kill a person.

Apparently, when a person is exposed to sour gas, the first thing that happens is the person will smell rotten egg odors. Second, the person's sense of smell diminishes, following that, the body becomes paralyzed. Death follows soon after. All within minutes depending on the concentration of sour gas.

They are technology novices, but they're passionate and they're getting smarter about where to place their bombs.

That's the theory being put forward by a pipeline security consultant after a third explosion in less than a month targeted EnCana's natural gas operations in Tomslake near the Alberta-British Columbia border.

"This one caused a breach, so these guys are definitely getting better at their bomb placement," said Oliver Salvador, who has experience protecting pipelines overseas. "They're getting smarter, and they're evolving as they go." Salvador is the executive director of CQB Group Inc., which, among other things, provides security and risk assessment for the oil and gas industry."

"This latest explosion occurred at a wellhead, where the natural gas comes out of the ground. The previous two were located at spots where the pipeline, which runs mostly underground, comes above the surface at an intersection known as a "riser." EnCana spokeswoman Rhona DelFrari said the targeted wellhead was "low volume" and has been producing since the late 1990s. She characterized the gas leak as "tiny," and the damage to the wellhead as a "dent."

As of Saturday afternoon, company engineers were still at the site working to stop the leak, which DelFrari said could take as little as a few hours or as long as a couple of days.

In the meantime, the leak poses no danger to the public, she said.

Salvador believes a group, rather than a single individual, is responsible for the bombings.

Team effort "That would be a lot of work for one person; he'd have to do all the intel himself, all the reconnaissance, the bomb-making, the bomb placement," said Salvador.

"It's always easier to accomplish multiple bombings in a team." He said whoever is responsible clearly knows the region and isn't intimidated by the presence of added security in the area.

And...

Added Salvador: "Whoever they are, they've got a lot of drive and a lot of guts. They're probably very

emotionally involved." He said it's possible the attackers believe they are putting on a "good show" in an effort to pressure EnCana, but genuinely do not want to cause human casualties or environmental damage.

And...

The first two bomb sites were found in October after an unsigned, handwritten letter was sent to the Dawson Creek Daily News warning EnCana to close operations and leave the Tomslake area by noon on Oct. 11.

"We will not negotiate with terrorists, which you are as you keep on endangering our families with crazy expansion of deadly gas wells in our homelands," the letter stated.

The first blast site was found Oct. 12.

On Oct. 16, a second bomb was detonated under a pipeline, leaving a crater that caused a minor leak that was quickly contained.

DAWSON CREEK, B.C. — Investigators from the Integrated National Security Enforcement Team renewed their call for the public's help Saturday as they continued to probe a third deliberate explosion targeting natural gas pipelines in northeastern B.C.

Crews from oil and gas giant EnCana, whose pipelines have been the target of all three blasts, were still at the scene near Dawson Creek at midday, trying to stop the flow of gas.

EnCana spokeswoman Rhona DelFrari said the leak is small and there is no dangerous hydrogen sulphide leaking from the damaged area.

The first blast on Oct. 11 was beside a sour gas line located about 50 kilometres east of Dawson Creek. The second occurred Oct. 16 along a pipeline off Highway 2, about half a kilometre from the Alberta boundary.

Police were called to the scene more than 12 hours after the blast when workers heard the sound of leaking gas from a wellhead northwest of the small community of Tomslake.

And...

“For investigators and from a public safety standpoint it's important for police to receive the information as soon as possible to contain the scene and potentially catch whomever is responsible for these acts.”

Ms. DelFrari said the company is required to have emergency plans in place for its wellsites.

“The plans tell us exactly when we have to alert the public if they could possibly be at risk,” she said.

“In none of these cases was there ever any indication that the public was at risk, or that we actually needed to alert people but we did it out of courtesy to some of the nearby residents.”

The natural gas from the wells contains a fractional trace of toxic hydrogen sulphide — 0.0005 to .0010 per cent, the company said — but not enough to pose a health hazard.

Many critics of sour gas development fear the gas, which can be fatal if enough of it is inhaled, poses a danger to people nearby.

The case has kindled memories of the vandalism that plagued Alberta's oilpatch in the 1990s.

There were more than 150 incidents at oil and natural gas facilities in northwestern Alberta between 1996 and 1998, ranging from shootings to nails found strewn along lease roads.

Alberta farmer Wiebo Ludwig, who blamed the energy industry and sour gas emissions for harming his land, livestock and family, was convicted of several charges related to oil patch bombing and vandalism and spent nearly two years in prison.

Northeastern British Columbia has become a hotbed for the oil and gas industry in recent months.

Several energy players have been flocking to the area in a bid to exploit the billions of cubic feet of natural gas trapped in the region's rock and sand.

VANCOUVER — A third attack has been discovered on a pipeline in the Dawson Creek area of northeastern British Columbia.

The target was a natural gas wellhead about 12 kilometres northwest of Tomslake, a small town near Dawson Creek.

A small amount of gas leaked, but the public is not in danger, the RCMP said in a statement. EnCana engineers were containing the leak, and the blast was in a rural, isolated area.

The blast site was discovered about 12:30 p.m. PT Friday.

EnCana spokeswoman Rhona DelFrari said there was “very minimal damage.”

“There are residents in the area but no one even living close enough that they would fall into our emergency response plan,” she said.

Calgary-based EnCana is a major player in the region. The company's Steeprock plant, a $60-million processing facility opened in 2006, was the biggest such plant to be built in B.C. in a decade.

EnCana has been operating in the area for about 14 years. The company says its sour gas pipelines are equipped with automatic emergency shutdown valves that would “shut in,” or contain, an affected part of a pipeline if a change in pressure – from, for example, a rupture resulting from an explosion – were detected.

And...

The RCMP's anti-terrorist unit, the Integrated National Security Enforcement Team, has taken the lead in the investigation because the attacks were directed at Canada's critical infrastructure, the force says.

And....

The Peace River area has been the focus of intense oil and gas activity for the past several years, with BP Canada planning to drill 132 new wells near Kelly Lake and the building of EnCana's $60-million Steep Rock gas plant in 2006. Along with all this activity have come growing concerns voiced by area residents.

Landowners near the hamlet of Tomslake, 28 kilometres south of Dawson Creek, protested on a gas industry access road this summer and the Kelly Lake Cree Nation blockaded a road for two days to underline their safety concerns.

Fake newspaper’ attacks Democrat Garfield County commissioner candidates: Bershenyi and Carter targeted

"GLENWOOD SPRINGS, Colorado — A fake newspaper reporting false and libelous attacks on Democratic Garfield County commissioner candidates has appeared in thousands of mailboxes throughout the county, according to candidate Stephen Bershenyi.

Bershenyi, a Democrat, is running against three-term Republican incumbent John Martin. Democratic candidate Steve Carter is competing for another county commission seat against Republican Mike Samson.

The newspaper-like mailing is the latest in a series of negative mailings and ads funded from sources outside the county.

“I had hoped that it wouldn’t be a part of this race,” Bershenyi said at a press conference in his home held in response to the mailing on Sunday. “This is the very kind of thing that keeps good people from running, and I am very glad to say to the citizens of Garfield County that I am equal to the task.”

The mailing is appears similar to a newspaper, with four pages and a masthead that says “The Garfield County Post.” The first issue anyone can recall ever seeing came out this weekend, but the mailing printed its publication date as Nov. 2, 2008, and says it is issue 80 of volume 64 of the publication. The newspaper-like mailing says it’s paid for by Western Slope Independent, and it lists a post office box in “Delores.” Dolores is a small town in southwestern Colorado near Cortez. Western Slope Independent is not incorporated and hasn’t reported any campaign contributions with the Secretary of State."

"The article suggests Bershenyi is a “well to do” multimillionaire. But Bershenyi, a blacksmith and artist, said he has a second job of driving a school bus near Basalt to help pay for his family’s health insurance. He thought the negative mailing is a sign of desperation.

“I think it’s probably the result of a situation where special interests realized they were about to lose control of the chairmanship of the Garfield County commission,” he said. “In their desperation, their only approach is to try to tear someone apart and destroy their character and discredit them as a human being, and to me it’s almost beneath comment.”

He said he will probably file a complaint with the Secretary of State after Tuesday’s election regarding the newspaper mailing."

"Overall, five groups outside the county spent around $45,700 in the past couple of months to influence this year’s two county commission races as of Oct. 24. About $31,500 went to ads supporting the Republican candidates or attacking Democratic candidates, while around $14,200 went to ads supporting the Democratic candidates or bashing Republican candidates.

A group of area mayors has endorsed the Democratic candidates and decried outside spending on ads attacking them. They said much of the funding came from the energy industry to support Republican candidates and was done by groups that failed to properly register or report the source of funds. Martin has said the mayors are hypocritical if they don’t form a political action committee because they endorsed candidates as a group and in political ads.

The weekend mailing, which looked very much like a newspaper, also included a story about the arrest of an “illegal Mexican alien,” but the article misspelled Garfield County Sheriff Lou Vallario’s last name."

 

   

 

   


COGCC Staff's Egregious Attempt to Undermine  The Intent of the New Rules

This is reprinted from Week 46, but it is so disgusting in the face of how poorly the 2004 seep has been administered and in the face of this new seep and how poorly it has been handled, that I am going to run it until the new rules are drafted in the hope that this inappropriate exemption will be stricken. If you have a moment, we sure would appreciate you voicing your support of striking this language. It only favors a big-time polluter at our expense. The Commissioners are in talks right now on what language to leave in and what language to take out. Thanks for any help you may try to bring to this situation. We definitely appreciate it! Relative to water quality standards, industry stands to enjoy all sorts of exemptions - particularly where they have polluted and continue to pollute West Divide Creek. Despite assurances we keep receiving from EnCana that the seep upstream is likely to go away, some folks appear to be reserving serious doubts. This has been pretty typical over the years. We're told all sorts of stuff, when reality is often something very different. But, an ignorant public is a placated public.

Basically, what you see below is a lot of scientific sounding stuff, but what it appears to mean is this: Limits to contaminants are to be kept low in normal circumstances, but where contamination has occurred before September 14, 2004 - a higher level of toxic metal and other contamination is to be acceptable. Acceptable to who? Not us, for sure! Who is deciding here and on what basis who gets clean water and who doesn't.  Of course, the seep in 2004, occurred in April of 2004. So, EnCana gets a fat exemption and we get to be poisoned. Why should EnCana benefit from these lower standards, by not being required to clean up to a safer standard the contamination they were found by the COGCC to have caused. And how did they cause the 2004 seep? The Schwartz well bore hole lost hundreds of feet of cement - presumably into a fault they intersected while drilling. They knew they had lost the cement, but decided to frac (blow the hell out of production zones with explosives) anyway. The same genius who ordered that frac job was still conducting the orchestra when we first started noticing bubbling again in 2007 after the Schwartz site was re-entered. It seems, based on staff-recommended "clarifications" of the safe levels rule, the COGCC feels that since it's just our one well in the creek downstream (plus all of Silt and Rifle), it's okay for us folks to suck up some extra "contaminant of concern" like toluene: 560 / 1,000; or, xylenes: 1,400 / 10,000. This is how the public is protected from industrial pollution.

As you read the stuff below keep in mind the "fist number / second number" thing. Basically, the first number is considered the safer number. The second number is considered "maximum exposure"  - you know... how much you can be expected to consume before your asshole falls out - stuff like that. How about these schmucks that decide it's okay for all of us to drink it, come and drink it themselves.

The second number in the range is a maximum contaminant level (MCL), established under the Federal Safe Drinking Water Act which has been determined to be an acceptable level of this chemical in public water supplies, taking treatability and laboratory detection limits into account. The WQCC intends that control requirements for this chemical be implemented to attain a level of ambient water quality that is at least equal to the first number in the range except as follows: 1) where ground water quality exceeds the first number in the range due to a release of contaminants that occurred prior to September 14, 2004 (regardless of the date of discovery or subsequent migration of such contaminants) clean-up levels for the entire contaminant plume shall be no more restrictive than the second number in the range or the ground water quality resulting from such release, whichever is more protective, and 2) whenever the WQCC has adopted alternative, site-specific standards for the chemical, the site-specific standards shall apply instead of these statewide standards.

Now, if I am misinterpreting this, then someone from the OCGCC needs to point it out. But it sure as hell looks to me like once, again, our health is on the chopping block for the benefit of billion dollar business.
